Terms and Conditions

Last updated: October 2026 · This is a translation for your convenience. In case of doubt, the German version prevails.

1. Scope and provider

These terms apply to all contracts concluded via websiteerstellen.eu between Müllner Performance & Trading GmbH, Seestrasse 20a, 7141 Podersdorf am See, Austria (“we”) and our customers (“you”), whether consumers or businesses. Deviating terms apply only if we agree to them in writing.

2. Services

Draft package: Based on your description, we use artificial intelligence to create three different website drafts and allow you 10 revisions by text request. You view the drafts online via your personal link. If you name websites as style references (up to three), one draft each follows their design (e.g. colours, font character, layout); texts, images, logos and other protected content of third-party websites are not copied. You only name publicly accessible websites.

Website: When you buy a draft, you receive the finished website with its own content management system (CMS, “Click & Change”) as a download package (ZIP) to run on your own hosting. Hosting and domain are not included; you rent them in your own name and at your own cost from a provider of your choice. The requirement is hosting with PHP 8.1 or newer (with the extensions pdo_sqlite, gd and mbstring) and Apache or LiteSpeed. The website is available in German or English.

AI edits in the CMS: You can change texts, images and all other content in the CMS yourself at any time, free of charge. In addition, the AI writes, rephrases or translates content for you; 10 such AI edits per calendar month are included free of charge for the first 3 months after buying the website (unused edits expire at the end of the month). You can buy further AI edits as a package (currently 20 edits for €20 or 50 edits for €50). Purchased credits do not expire as long as your website is connected to our platform; they cannot be paid out. By buying, you expressly request that the credits are provided immediately.

Customer account: In your customer account you find your orders, invoices, the website download and your AI credits. You sign in with a one-time link sent to your email address.

3. Conclusion of contract

The presentation on the website is not a binding offer. By submitting the brief and clicking the payment button, you make a binding offer. The contract is concluded once payment is confirmed; we then send you a confirmation with invoice by email. The same applies to buying a website or AI credits.

4. Prices and payment

The prices shown on the website at the time of ordering apply. Currently the draft package costs €5 and the website €390 (offer price, regularly €790). The price of the draft package is fully credited when you buy the website. All prices are final prices; as a small business we do not charge VAT.

Payment is made in advance via PayPal (with a PayPal account or by credit or debit card via PayPal). You receive invoices by email as PDF and in your customer account.

5. Your cooperation and content

You are responsible for the accuracy of your details. The AI creates text suggestions; placeholders in square brackets (e.g. [Phone number], [Price]) must be replaced with correct details before publication. Please check all texts before publication, especially prices, services and legal information.

If you supply your own content (texts, photos, logos), you confirm that you hold the necessary rights and indemnify us against third-party claims arising from an infringement of these rights.

We provide templates for the legally required information on your website (legal notice, privacy policy). Responsibility for their completeness and accuracy lies with you as the operator of the website.

6. Provision

After buying, your website package is immediately available on your personal download page and in your customer account; we also send you the link and the setup code for the CMS by email. You upload it to your hosting yourself using the included instructions. Email mailboxes, hosting and domain are not part of the offer.

7. Rights of use

Upon full payment, you receive the unlimited, non-exclusive right to use the website with its texts and design as well as the included CMS for your business on one domain. The underlying software and design templates remain our intellectual property; passing them on, reselling them or using them for further websites is not permitted. Photos from the Unsplash image library are subject to the Unsplash licence.

8. Operation, AI function and updates

You are responsible for operating the website on your hosting, for backups (especially of the “data” and “media” folders) and for complying with the legal obligations of your website (e.g. legal notice, privacy policy). AI edits in the CMS work via a connection to our platform; the texts of your website are transmitted to us and our AI provider for processing. We provide this connection within the limits of what is technically reasonable. In case of misuse, we may block the AI function for a website. There is no entitlement to future updates of the CMS.

9. Warranty and liability

Statutory warranty provisions apply. Your hosting provider is responsible for the availability of your website. We ensure high availability of the AI function but cannot guarantee uninterrupted availability.

We are liable for damages only in cases of intent and gross negligence. This does not apply to personal injury or where mandatory statutory provisions (in particular consumer protection law) provide for further liability. Towards businesses, liability for lost profits and consequential damages is excluded and limited in amount to the order value.

10. Right of withdrawal for consumers

11. Data protection

How we handle your data is described in our privacy policy.

12. Final provisions

Austrian law applies, excluding the conflict-of-law rules of private international law and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence. The place of jurisdiction for businesses is the court competent for Podersdorf am See. Should any provision of these terms be invalid, the remainder remains unaffected.
